Terms of Service

These Terms govern your use of HIPAA Policy Engine ("the Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Informational service only

The Service generates policy templates. The Service is not a law firm, does not provide legal advice, and using the Service does not create an attorney-client relationship. See our Not Legal Advice page.

2. Your responsibility

You are responsible for the accuracy of the information you provide, for reviewing the generated policies (with counsel as appropriate), and for your practice's compliance with HIPAA and applicable state law. The Service does not guarantee compliance.

3. No PHI

You agree not to submit Protected Health Information (PHI) to the Service. The Service is not designed to receive PHI, and no Business Associate Agreement is offered or required.

4. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

5. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months prior to the event giving rise to the claim. In no event will we be liable for indirect, incidental, special, consequential, or punitive damages.

6. Termination

You may cancel at any time. We may terminate or suspend the Service for breach of these Terms or for non-payment. Upon termination, your adopted policies and audit log remain accessible for a reasonable wind-down period.

7. Governing law

These Terms are governed by the laws of the state in which the operator of the Service is headquartered, without regard to conflict-of-laws principles.
